Terms of Use

These Terms of Use (“Terms”) govern your use of 380 Football (also styled 38-0 and 38-0 Football Sim; “the app”), the website at 380football.com, the web version at play.380football.com, and any related games, features and services we provide (together, “the Service”). The Service is operated by the team behind 380 Football (“we”, “us”, “our”).

By downloading, accessing or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. Who can use the Service

The Service is a casual football game intended for a general audience. You must be old enough to agree to these Terms in your country (and at least 13). If you are under the age of majority where you live, you should review these Terms with a parent or guardian. You are responsible for any use of the Service through your device.

2. Licence to use the Service

We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to download and use the Service for your own personal, non-commercial entertainment, in line with these Terms and (where you install through an app store) that store’s rules. We may update, change or withdraw the Service, or any feature of it, at any time.

3. Our intellectual property

We (and our licensors) own all rights in the Service that we have created, including our software and source code, original artwork, graphics, audiovisual content, the game’s simulation engine and underlying logic, our compilations and arrangement of data, our written content, our logos and the specific look, layout and presentation of the app and website. These are protected by copyright and other laws, and nothing in these Terms transfers any of those rights to you. You may not copy, reproduce, adapt, decompile, reverse-engineer, scrape, extract, republish or create derivative works from any part of the Service, except to the limited extent the law expressly allows and cannot exclude.

“380 Football” and “38-0” are how we refer to our game. We make no claim to exclusive rights in descriptive or generic football terms, in real club or player names, or in the general idea of a football management or squad-building game; our rights are in our own original code, content and presentation as set out above.

4. Acceptable use

When using the Service, you agree not to:

• use it for any unlawful, harmful, fraudulent or abusive purpose;
• cheat, exploit, tamper with, automate, manipulate or attempt to falsify results, leaderboards, leagues, challenges or any anti-cheat or scoring system;
• attempt to gain unauthorised access to the Service, our servers or other users’ data, or to disrupt, overload or interfere with the Service or its security;
• reverse-engineer, copy or build a competing product out of our code, content or data; or
• use the Service in any way that infringes the rights of, or restricts or inhibits the use of the Service by, anyone else.

We may suspend, restrict or remove access (including removing results, names or accounts from our online features) if we reasonably believe these Terms have been broken, without notice where appropriate.

5. User content (names you choose)

Our optional online features let you enter a manager name and create or name leagues. You are responsible for any content you submit, and you must not submit anything that is offensive, infringing, misleading, impersonating, or otherwise unlawful or against these Terms. Display and league names are public, self-chosen pseudonyms and are filtered for offensive content; we may change, reject or remove any name at any time, at our discretion. By submitting content you grant us a non-exclusive, royalty-free licence to host, display and use it for the purpose of operating the Service. To report a name, email hello@380football.com.

6. Purchases and 38-0 Pro

Some features are unlocked by 38-0 Pro, offered as a one-time purchase or, where available, a subscription. Purchases are processed entirely by the store you buy through (Apple’s App Store, Google Play, Steam, or, on the web, our payment provider) and are subject to that store’s terms, pricing and refund policies. We do not process or store your payment details. Subscriptions renew and can be cancelled in line with the relevant store’s rules. Except where required by law or by the relevant store’s policy, payments are non-refundable. Prices and the features included in Pro may change over time.

7. Third-party services and app stores

The Service is distributed and supported through third parties (including Apple, Google, Steam, our hosting and analytics providers, and our purchase-management provider), each with their own terms and privacy policies. Your use through those platforms is also subject to their rules. We are not responsible for third-party services, websites or content that we do not control.

8. Apple App Store

If you obtained the app from Apple’s App Store, the following also applies: these Terms are between you and us only, not Apple, and Apple is not responsible for the app or its content. Apple has no obligation to provide any maintenance or support for the app. Apple is not responsible for any product warranties, whether express or implied. In the event of any failure of the app to conform to any applicable warranty, you may notify Apple and, where applicable, Apple may refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation in respect of the app. Apple is not responsible for addressing any claims by you or any third party relating to the app, including product-liability, legal or regulatory, and consumer-protection claims, or any claim that the app infringes a third party’s intellectual property rights. Such claims are governed by these Terms and handled by us. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You confirm you are not located in a country subject to a relevant embargo and are not on any prohibited-parties list.

9. Unofficial and unaffiliated

380 Football (38-0) is an independent, unofficial fan project. It is not affiliated with, endorsed, sponsored or approved by the Premier League, the English Football League, UEFA, FIFA, any football club, competition organiser, player, players’ association, or any games publisher. Real club and player names are used for identification and informational purposes only, as text, and no official names, logos, crests, kits or trademarks are used. Any references to real teams or players do not imply any endorsement or association.

10. No warranty: the Service is provided “as is”

The Service is provided “as is” and “as available”, for entertainment only. To the fullest extent permitted by law, we make no warranties or representations of any kind, express or implied, including as to availability, accuracy, reliability, fitness for a particular purpose, or that the Service will be uninterrupted, error-free or secure. Game outcomes, simulations, ratings and statistics are for entertainment and are not a prediction of, or statement about, real sporting performance. You use the Service at your own risk.

11. Limitation of liability

Nothing in these Terms limits or excludes our liability where it would be unlawful to do so: this includes liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be limited or excluded under the law that applies to you. If you are a consumer, you have legal rights that these Terms do not affect.

Subject to the paragraph above, and to the fullest extent permitted by law:

• we will not be liable for any indirect, incidental, special or consequential loss, or for any loss of profits, revenue, data, goodwill, savings or opportunity, however arising;
• we will not be liable for any loss or damage that was not reasonably foreseeable, or that arises from your misuse of the Service, from issues with your device or internet connection, or from third-party platforms, stores or services; and
• our total aggregate liability to you arising out of or in connection with the Service and these Terms will not exceed the greater of (a) the total amount you paid us (if any) for the Service in the 12 months before the claim, or (b) GBP 100.

The Service is a free-to-play game (with optional low-cost purchases), and these limits reflect that.

12. Indemnity

To the extent permitted by law, you agree to indemnify and hold us harmless from any claims, losses, liabilities and reasonable costs arising out of your misuse of the Service, your breach of these Terms, or content you submit.

13. Availability and changes to the Service

We aim to keep the Service running but do not guarantee that it will always be available or unchanged. We may modify, suspend or discontinue the Service or any feature (including online leagues, leaderboards and challenges) at any time, and we are not liable to you for doing so.

14. Suspension and termination

You may stop using the Service at any time and delete the app. We may suspend or end your access to the Service, or any online feature, if you breach these Terms or where we reasonably need to. Provisions that by their nature should survive termination, including intellectual property, disclaimers, limitation of liability and governing law, will continue to apply.

15. Governing law

These Terms, and any dispute or claim arising out of or in connection with them or the Service, are governed by the laws of England and Wales, and are subject to the non-exclusive jurisdiction of the courts of England and Wales. If you are a consumer resident elsewhere, you may also benefit from any mandatory protections of the law of your country of residence, and nothing here removes those.

16. Changes to these Terms

We may update these Terms from time to time. If we do, we will post the updated version on this page and change the “Last updated” date above. Your continued use of the Service after changes take effect means you accept the updated Terms.
